Bail Bonds Cost 10% in Florida

For Florida state bonds, the bail bond premium is 10% of the bond amount set by the court. The Florida Department of Financial Services states that the premium for a state bond is 10% of the bail amount set by the court, while federal bonds are 15%.

Florida law requires a bondsman to charge 10% of each bond that is over $1,000. Any bond less than $1,000 is a flat $100. That amount is the bail bond premium. It is the fee paid to the bail bond agency for posting the bond and taking responsibility for the defendant’s appearance in court.

What Is the Difference Between Bail and a Bail Bond Premium?

Bail is the total amount the court sets as the condition for release. A bail bond premium is the fee you pay a licensed bail bond agency to post that amount on your behalf. If the court sets bail at $10,000, most families are not in a position to hand over $10,000 in cash directly to the jail. With a surety bond, Bail Bonds Now posts the full $10,000 through a licensed local agent. The required premium for a Florida state bond at that amount is $1,000. That $1,000 is the cost of the service, and the $10,000 stays with the court until the case resolves.

What Are Transfer Bonds?

A transfer bond applies when a bond needs to be posted in one county while the defendant is being held in another. This comes up when someone is arrested outside the county where their case originated, or when a warrant from one county is processed while the defendant is detained somewhere else.

Transfer bonds require more coordination between agents and counties. Florida Administrative Code allows for certain additional fees in situations when agents from different counties are involved. These can include an execution and transfer fee of up to $100, and a travel fee of $50 for each county the agent travels through using the most direct route.

If the posting agent must travel through two counties to complete the transfer, the transfer fees would typically come to $200: $100 for the transfer itself, $50 for the first county and $50 for the second. That amount is separate from and in addition to the bail bond premium for the underlying bond.

Are There Any Other Fees?

Florida limits what bail bond agents can charge. Administrative Code is clear that an agent cannot collect fees beyond the premium unless those fees are specifically permitted by statute or rule. Depending on the situation, permitted costs may include transfer bond fees, documented transportation expenses outside the court’s jurisdiction, certain costs related to court proceedings and credit card processing fees where applicable.
